As of April 2014 Liberty Mutual was the 2nd largest property and casualty insurer in the US. I do not think that their presence is as big in Florida as some other states.
Casualty insurance pays an injured person for his or her damages. In Florida, Liberty Mutual insures against many different types of accident claims.
Florida Auto Accident Claims
In Florida, Liberty Mutual insures many different types of autos. They include cars, motorcycles and specialty vehicles. Specialty vehicles include boat and watercraft, antique and classic cars, ATV and off-road vehicles, and recreational vehicles (RVs).
Florida Car Accident Claims with Liberty Mutual
Liberty Mutual provides car insurance in Florida. When it comes to Florida insurer reputations for paying injury claims, Liberty Mutual is above average.
That means that if you are injured in a car accident caused by someone who is insured with Liberty Mutual, then you are more likely to get a higher offer for your damages than if you were hit by someone whose insurer is average or worse.
I have represented injured people against all, or close to all, of the major auto insurers in Florida. However, there are over 33 factors that affect how much an injury case is worth.
Liberty Mutual Insurance has made a business decision to be an above average insurer in terms of paying injury claims.
Liberty Mutual is more likely – than many other insurers – to pay fair value to an injured person instead of paying its attorneys to defend a claim.
So if someone’s car crashed into your vehicle and you tore your rotator cuff (shoulder), then Liberty Mutual is more likely to offer a more reasonable settlement under its insured’s bodily injury (“BI”) liability coverage than many other insurers.
Before you get too excited, you should note that I know several attorneys in Florida who are not big fans of Liberty Mutual. There are other auto insurers in Florida that have a better reputation for making more reasonable offers to settle injury claims.
Generally speaking, Liberty Mutual pays better than a company with a self-insured retention (SIR). So that means that if you were to injure your rotator cuff from an accident in Florida, odds are that if all things are equal then you may get more money from Liberty Mutual than Walmart or Publix.

My Actual Case: $100,000 Settlement for woman who had back surgery after she was hit by a truck that was insured with Liberty Mutual Insurance.
The amount of this settlement is before attorneys’ fees, doctors’ bills, etc. were deducted. The bodily injury liability policy limits were $100,000.
She had a percutaneous discectomy (back surgery on her back). After the crash, she had complaints of lower back pain. She treated with a chiropractor for a few months but the pain did not go away.
She had epidural steroid injections to her lower back. Her pain still did not go away so she had lower back surgery.
As in most cases, because the person/company that caused this accident only had $100,000 in bodily injury (BI) insurance, they did not have assets to go after.
If you look at past Florida jury verdicts or ask a claims adjuster, this was an above average settlement for a case involving a herniated disc caused from an accident in Florida.

Part of the reason that this was an above average settlement for a back injury case in Florida is because my client had back surgery. This settlement was one several car accident settlements that I have had against Liberty Mutual for clients who were injured.
Florida Motorcycle Accident Claims with Liberty Mutual
The motorcyclist may own a car with uninsured motorist (UM) liability coverage.
Liberty Mutual also offers UM liability coverage on motorcycles.
ATV and Off-Road Accidents
Liberty Mutual insures ATVs in Florida.
Recreational Vehicle (RV) Accident Claims with Liberty Mutual in Florida
Liberty Mutual insures motorhomes and travel trailers on the road or wherever they are parked. However, they require an underlying Liberty Mutual Auto Insurance policy.
Motorhome and travel trailers may have BI liability coverage. If a motor home or travel trailer causes a person’s injury, he or she can make a claim against the BI coverage.
Home Insurance Claims against Liberty Mutual in Florida
Liberty Mutual insures many different types of Florida home injury claims. They include accidents caused by:

Homeowners claims against Liberty Mutual in Florida
Liberty Mutual provides homeowners insurance to protect the homeowner from personal injury claims.
On premises claims
A homeowner’s negligence may cause someone to get injured on the premises. The injured person can make a claim against Liberty Mutual homeowners insurance for his or her damages.
Example – Trip and Fall
A grandmother is babysitting her grandchildren at her daughter’s house. The daughter’s home is insured with Liberty Mutual.
The grandmother trips on an improperly placed cable. The grandmother can make a claim with Liberty Mutual for her damages.
Example – Dog Bite
You are bitten by a homeowner’s dog. You may make a claim with Liberty Mutual for damages. These include medical bills, lost wages, pain and suffering.
Off property claims as well
Liberty Mutual home insurance covers the homeowner in certain situations while off the property as well.
Example – Shopping Cart Accident at the Store
Liberty Mutual insures a Florida homeowner. The homeowner pushes a shopping cart into another shopper.
The other shopper suffers a hip fracture. The injured shopper can make a claim against the homeowner’s Liberty Mutual insurance.
Injury Claims Against Condo Owners Covered by Liberty Mutual in Florida
Liberty Mutual condo insurance gives the owner personal liability coverage. This covers accidental bodily injury caused by the owner, an immediate family member living in the home and pets.
It also covers the owner for lawsuits.
It comes with medical payments coverage. It covers the owner for medical bills for someone other than the owner or his or her family, who has been in an accident on the property.
Some injury claims against Liberty Mutual condo insurance may be:
- Slip, trip and falls
- Dog bites
The injured victim may also have a case against the condo association if the accident occurred in a common area.
Liberty Mutual also offers workers compensation insurance. If you are injured while you are working, and your employer has Liberty Mutual workers compensation insurance, then Liberty Mutual may give you benefits.
I represent (along with a different law firm) people who are injured while working (on the job).
I have settled (as co-counsel) many workers compensation claims. If you were injured while on the job, you may be entitled to money in addition to the money paid for your lost wages and medical bills.
Do not expect the workers compensation claims adjuster to tell you this. This is one of the many reasons why it is important to have an attorney to handle your workers compensation claim.
If you are making a workers compensation claim against Liberty Mutual, don’t expect Liberty Mutual to pay you for your pain and suffering. This is because workers compensation laws in Florida do not allow for pain and suffering.
Sometimes workers compensation settlements are much smaller than personal injury settlements where someone else was at fault. There are rare times where a Florida worker can sue for personal injury though.
General Liability (Claims against a business, hotel, store, shopping mall, etc.)
Liberty Mutual also provides general liability insurance. That means that if you are injured at a hotel, store, shopping mall or other business, then you may end up dealing with Liberty Mutual.
Similar to homeowners insurance, a general liability insurance policy may have “medical payments” coverage, which would pay for your medical bills regardless of fault.
My Actual Case: $31,500 Settlement with Liberty Mutual when my client’s leg was sliced up when a glass shower door broke. He was exiting the shower at a W-hotel in Fort Lauderdale, Florida.
My client had pictures of the cut, which looked pretty bad.
However, the cut healed very nicely and left little scarring. Scarring claims on men are generally worth less than on a woman. Women are generally more psychologically (mentally) affected by having a scar than a man.
This case was the perfect example of the importance of taking pictures following the incident. My client was smart and took pictures immediately after the incident.
If my client did not have pictures of his injured leg, this case would probably have settled for a much smaller amount. The wound healed very nicely with little scarring. Liberty Mutual insured the hotel in this case.
In the hotel case mentioned above, the hotel’s general liability insurance policy had medical payments coverage, which paid for all of my client’s medical bills.
Liberty Mutual paid $31,500 for pain and suffering, which was in addition to the medical bills.
Liberty Mutual paid this amount because they must have felt that I had a good shot at proving that the W-hotel was negligent with the type of glass door that was used in this particular shower.
I believe the glass was non-tempered glass. I argued that tempered glass should have been used and would have prevented my client’s leg from being sliced up and requiring many stitches.
You may also still have a separate claim against another party (company) such as a shower glass installer even if you think you are getting a fair settlement from Liberty Mutual.
Don’t expect for Liberty Mutual to tell you that another company may also be responsible to pay for your personal injury claim.
If you contact the other company and they tell you that they are not responsible for the incident or your damages, do not believe them. If an insurer tells you that it has closed your claim, it may be meaningless.
If a truck insured with Liberty Mutual hits you, then in order to get pain and suffering you have to prove that the truck driver was at fault and this caused your injuries.
There is a time limit to sue for a claim based on negligence in Florida. You therefore have a limited time to sue the truck driver, company or dispatcher.
If you have Personal Injury Protection (PIP) insurance or uninsured motorist insurance with Liberty Mutual, you should report the claim in writing to Liberty Mutual as soon as possible following the accident.
Boat and Watercraft Accident Claims
Liberty Mutual insures boats or watercrafts with liability insurance. It protects the boat or watercraft owner and passengers from personal injury.
The boat is insured while on water and on land. The boat and trailer are covered. BI liability coverage and medical payments coverage is optional.
Liberty Mutual Insurance Company is the 14th largest Florida aircraft accident insurer. The 2014 Annual Report states that its written premiums were $3,124,032. Its market share was 3.3%
Products Liability Claims
The 2014 Annual Report states that Liberty Mutual Fire Insurance Company was the 13th largest Florida product liability insurer.
Products liability deals with the recourse for personal injury or property damage resulting from the use of a product.
An example of a products liability claim is if part of a baby crib breaks and a child’s arm gets fractured.
Liberty Mutual’s products liability written premiums in Florida were $3,785,767. Its market share was 1.8%.

You may need to know the proper name if you ultimately need to file a civil remedy notice of insurer violation if they do not act in good faith.
