I once heard an attorney say that a doctor is more important in a personal injury case than an attorney.
To a certain extent he is correct. The attorney who said this was referring to the importance that a doctor plays in your case if you were injured in an accident caused by someone else.
Florida is a huge state and even the most skilled personal injury lawyers in Florida don’t know a “Plaintiff friendly” doctor in every part of the State. I use the term “Plaintiff friendly” which is also known as a “patient advocate” or “doctor that won’t kill your case.”
You see, in many cases the insurance adjuster or defense attorney – both who represent the person or company that you are making a claim with or against – will hire a doctor that often says the following 3 things:
- Your injury is old and pre-existed the accident that you are making a claim for.
- Your injury was not caused by the accident.
- Your injury is not permanent.
You may ask, “Who cares what the doctor says? I know I was injured in this accident and the person who caused it has to pay for my injuries.”
Not so fast. You have to prove that your injuries were caused or aggravated (worsened) by the accident. In certain types of cases in Florida, you need to prove that your injury is permanent in order to try to get money for pain and suffering.
These “insurance company” or “defense doctors” can be one of the many factors that can help or kill your injury case. Some of these “defense doctors” make a handsome living by examining claimants and Plaintiffs in personal injury cases.
Some defense doctors can make a million dollars a year doing this. So, if your injury falls into a grey area, many defense doctors will surely side with what the insurance company wants to hear.
The good news is that there happen to be some doctors, as I described at the top of this article, which will go to bat for you and hopefully not kill your case. Below are some links to articles for different medical specialties.
