Face Injury and Bone Fracture Settlements (Car Accidents, Falls and More)

Bones of the Face: Mandible, Maxilla, Nasal Bone, Zygomatic Bone

If someone’s negligence caused you to injure a bone in the face, you may be entitled to compensation.

The four main bones in the fact are:

Each state has different laws in regards to personal injury claims.  This article applies to personal injury claims for facial bone fractures that occurred in Florida or on a cruise.  Each state has different laws.

I wrote a separate article on nose fractures in Florida and cruise accident cases.  In that article, I talk about a lady who received a $78,000 settlement after she tripped and fell and had nose surgery.

All settlements in this article are before deduction for attorney’s fees and expenses. Most cases result in a lower recovery. It should not be assumed that your case will have as beneficial a result.

I also wrote a separate article on head and brain injury claims in Florida.  Head injuries can occur with a face injury.

Some facial bone fracture claims result in scarring and disfigurement.  However, here, I don’t focus on getting paid for scarring & disfigurement in a Florida accident.

Let’s first look at some face bone fracture cases in Florida.

Pedestrian Gets $110,000 Settlement for Orbital (Eye Bone) Fracture from Car Crash

Crash diagram.

Check out this $110,000 settlement for a pedestrian who was hit by a car in Homestead, Miami-Dade County, Florida. She suffered an orbital (facial bone) fracture with surgery.

Progressive was the uninsured motorist insurer.  Imperial Fire & Casualty (RAC) insured the careless driver.

The pedestrian (my client) received the ticket.  However, we still got an $110,000 settlement.

Pedestrian accident cases can settle for big money because the injuries are often serious.

Bicyclist Gets $100,000 after Truck Hit Her, Fracturing a Facial Bone

Re-created accident diagram.

Check out a $100,000 settlement for a bicyclist after a pickup truck hit her in Cooper City, Broward County, Florida. She suffered facial fractures and collapsed lungs.

USAA insured the driver who was at fault.

$78k Settlement for Nose Fracture from Fall at Condo (Miami)

Large step down between the hallway and the landing area.

A lady owned a condo unit in Sunny Isles, Miami-Dade County, Florida.  She actually lived in another country.

While exiting a door in the common area of the condominium building, she misstepped.  The photo above shows the door.

She fractured her nose.  In her home country (Colombia), she had surgery on his nose.

Scottsdale Insurance Company insured the condominium building.

I settled her personal injury case for $78,000.  Most of her settlement was for pain and suffering.

$5,000 of the settlement was from Medpay coverage in the condo’s insurance policy.  I did not charge a fee on the $5,000 Medpay recovery.

Restaurant Guest Gets $18K Settlement for Cut to Face (Trip and Fall)

Check out our $18,000 settlement for a lady who cut her face when she tripped and fell at a South Miami restaurant.  Her foot struck a protruding landscaping edge outside a South Miami, Florida restaurant.  She fell into a parking bumper/wheelstop.

Bicyclist Gets $17,500 Settlement after Car Hits Her, Causing Cut Below Chin

We represented a bicyclist after a car hit her.  She sustained lacerations to her chin.  She also had staples in her abdomen to close up a gash there.

We made a claim against State Farm.

State Farm insured the car driver.  They paid $17,500 to settle the case.

If you have an injured tooth, will Florida PIP auto insurance pay for you to see a dentist?

People who have a face injury may also have an injured tooth.  This could include a broken crown.  If your accident happened in Florida, PIP auto insurance may pay your dentist’s bills if you are covered with PIP.

What is the Best Insurance Situation for Someone Who Has Suffered a Serious Facial Injury?

Unfortunately, many people who suffer facial injuries get a below fair value settlement because of limited insurance.

Someone with facial injuries has a better shot at getting fair value if there is enough bodily injury liability (BIL) insurance available.   There are a few situations where there will likely be enough BIL insurance to pay the fair value of the case.

One is the victim was hit by an Uber or a Lyft car that was engaged in a ride.  In Florida, Uber and Lyft cars have at least $1 million of BIL insurance if the driver was engaged in a ride.

Another situation where there will likely be enough insurance is if a tractor trailer caused the accident.  Tractor trailer accident settlements tend to be bigger because there is plenty of insurance.

Just look at some of my biggest personal injury settlements.  Many of them are for people hit by 18 wheelers.

What symptoms increase the full value of a facial injury case?

The following may increase the full settlement value of a facial injury case:

Keep in mind that you need to show that someone’s carelessness caused these injuries in order to have a personal injury case.  I am not referring to a workers compensation case.

Is your Case Worth less Money if you just treat your facial injuries at home?

Yes.  You should do what you think is best for your health.  However, if you only have home treatment, don’t expect much in way of a settlement.

Does a medical evaluation and treatment for your facial injury increase the claim’s full value?

Yes.  When in doubt, seek medical treatment and an evaluation.  Medical treatment shows that you may be injured.  Medical bills increase the full value of the case.

Take pictures of your facial injury

Take pictures of your facial injury with a good quality camera.  Nowadays, most new phones are good quality.  Take several pictures and don’t rely on blurry ones.

Pictures come a long way in showing your pain and suffering, loss of enjoyment of life and other compensation that you may be entitled to.

Pictures may also help you prove that the accident caused your injury.  If you have to sue to get fair value for your case, the defense can hire a doctor to examine you.

Defense doctors often say that the accident did not cause the claimant’s injury.

His face injury was a lateral wall orbit fracture.  He fracture his upper leg bone (femur).
