Kendall Car Accidents: Attorney Injury Settlements and Claims

If someone’s carelessness caused your car accident in Kendall, Florida, your case may be different than if you’re accident happened in another city.

Here are some fast facts that you need to know for Kendall injury claims arising from car accidents.

Higher Chance that Drivers in Kendall have Insurance

If a careless driver hits you in Kendall, Florida, there is a greater chance that he or she has bodily injury (“BI”) liability insurance than if the crash happened in some other cities like Homestead and Hialeah.

This is good for injured victims because BI liability insurance isn’t usually required on cars in Florida.

There is also a higher likelihood that the driver who hit you in Kendall has a higher BI insurance limit than in some other cities in Miami-Dade County.

What insurer is the careless driver likely to have in a Kendall crash?

The five most common auto insurance companies that I see in Kendall car accidents are State FarmGEICO, Progressive, Allstate and United States Automobile Association (USAA).

Kendall Accident Victims Get Better Jurors

If someone’s carelessness caused your accident in Kendall, Florida, your case will likely be decided by a Miami-Dade county jury.  However, most cases settle before trial.

Though there is no guarantee, Miami-Dade County juries tend to award more money than jurors in more rural parts of Florida.  So, if you’re hurt in Kendall, you are likely to get a better jury than if you are hurt in a rural area in Florida.

Hispanics may do better in Kendall accident claims

As a rule of thumb, jurors in Miami-Dade County (where Kendall is located) award more to Hispanics than other ethnicities.  (However, every case is different so you have to look at the details.)

Insurance claims adjusters and defense attorneys know this.   Examples of Hispanics are Cubans, Central Americans, South Americans, etc.

Hispanics generally due better because a jury in a Kendall injury case will likely be mostly made up of Hispanics. Hispanics tend to award other Hispanics more than other ethnicities.

That being said, whites, blacks and others can still do well in a Kendall accident case.  The facts of the case are more important than the injured person’s ethnicity.

Let’s take a look at some Kendall car accident settlements.

Three cars were traveling southbound on SW 127th Ave in The Crossings, which is next to Kendall.  The Crossings borders the Hammocks, Three Lakes and Kendale Lakes.

A car failed to stop in time and ran into the rear of another car.

It pushed the middle car into the front car (Vehicle 3), which my client was driving.  An ambulance came to the scene and treated every person involved.

An ambulance took my client to the hospital.  The driver of the Vehicle 1 received a ticket.

My client had shoulder surgery.  Progressive insured the middle car.  Progressive paid $10,000 to settle the case.

My client had wrist surgery as a result of the wreck.  The total available insurance was only $35,000.

The other driver failed to slow down.  The front of his car collided with the rear of the car that my client was a passenger in.

The at-fault driver’s car had disabling damage.  It was towed from the scene.  His airbag deployed.

The at-fault driver was charged with DUI.  An ambulance did not arrive at the scene.

Joe did not take an ambulance to the hospital.  The next day he went to the hospital.

At the hospital, he told the nurse that he had pain in his head, neck, back and both shoulders.  He was treated in the hospital for a few hours.  The hospital records said that he had no pain when he left the hospital.

A few months after the crash he saw a neurologist.  The neurologist noted that he had muscle spasms in his lower back.

The neurologist diagnosed him with Post Concussive Vertigo, and Lumbar Myofascitis.

A South Florida auto insurer insured the DUI driver.  They paid us their $10,000 limits.  State Farm was Joe’s UM insurer.

He did not want to sue State Farm.  State Farm paid $4,100 to settle the case.

The total settlement was for $14,100.

Who is the best Kendall accident lawyer?

Attorneys can’t ethically say that they are the “best Kendall injury lawyer.”  However, there are important factors to look at when hiring an injury lawyer.

If you’re hurt in Kendall, I suggest that you strongly considering hiring an injury lawyer whose office is close to your home or the accident scene.

You should also hire a lawyer who knows Florida personal injury law very well.
