You will not get a copy of the Miami-Dade County Fire Rescue (MDFR) report at the accident scene.  You have to request it.

I requested the Paramedic Report

I immediately requested the MDFR report and billing records.  They can take a few weeks to get.

Paramedic Report stated bike rider fell off bike

The report stated that the bike rider told the paramedics (MDFR) that he was riding his bike next to the curb of Biscayne Blvd.

He said that a car got too close and he fell off his bike out of fear.  He did not lose consciousness.

Bike rider complained of arm pain

The paramedics stated in the report that:

The paramedics said that he had possible muscular/skeletal/soft tissue damage.

They advised him to clean his cuts when he got home.  He refused to be transported to the hospital.

Injured man has broken wrist and elbow

The bike rider went to a doctor.  He was diagnosed with a fractured wrist and elbow.

Bike rider had $10,000 uninsured motorist policy with GEICO

The bike rider had a $10,000 uninsured motorist (“UM”) insurance policy with GEICO.  His UM insurance was nonstacking.

In Florida, if a car runs you off the road and leave the scene, the car is considered “uninsured“.  This is true even if the car doesn’t touch you.

GEICO paid us the $10,000 limits of my client’s uninsured motorist insurance.

Are drivers likely to be insured in North Miami?

Most drivers in North Miami have bodily injury (“BI”) insurance.  This is true even though car owners don’t have to have BI insurance in North Miami.

However, they will likely have limits of $10,000 per person.  This is because North Miami is a relatively poor city.

North Miami is a good venue for injured crash victims

On the bright side, if someone caused your car crash in North Miami, you will likely get a better jury than if you were hurt in many other cities in Florida.

However, if you had owned a car at the time of your crash in Florida, and you didn’t insure it, you won’t qualify for PIP.  You also won’t be able to sue the careless driver for your PIP deductible and 80% of your medical expenses up to $10,000.

This applies even if the negligent driver was completely at fault.  This is because Miami-Dade County car accident law penalizes uninsured injured car accident victims.

In this scenario, the tortfeasor driver may get up to a $10,000 credit against your claim for your medical bills and lost wages.  Some other Florida counties don’t have this penalty.  But it applies to most North Miami car accident cases.

How to get County Paramedic Records and Billing after a North Miami Car Crash
