Barton’s Fracture from a Fall, Car or Motorcycle Accident and More

If you have a Barton’s fracture from an accident, you may be able to get compensation.  Barton’s fractures are fractures of the distal radius.

It is also sometimes called the dorsal type Barton fracture, which is different from the volar type or reverse Barton fracture.  “Volar” means the same side as the palm of the hand.

Barton fractures can be caused by falling and other types of accidents.

Do Barton’s Fractures Damage Your Joint?

Barton fractures extend through the dorsal part to the articular surface but not to the volar aspect.

Since a Barton fracture goes through the articular surface, it involves the joint.  Fractures that damage the joint increase the chance that you’ll develop post-traumatic arthritis.

How Much Are Barton Fractures Worth?

Juries tend to award more money for pain and suffering for a Barton’s fracture since it damages the joint.

Ask the orthopedic surgeon who operated on you if you’re likely to get post-traumatic arthritis from the fracture.  If the doctor says yes, this adds value to the pain and suffering component of a Barton fracture case.

Ask the doctor to put this in his report.

Ask the orthopedic surgeon (who operated on you) if he or she thinks that you’re reasonable certain to need a future surgery.  If the answer is yes, ask the doctor to put this in his report.

A future surgery drives up the full value of the pain and suffering component of the case.

Barton’s Fractures Usually Involve Dislocation of Radiocarpal Joint

A Barton fracture is like a Colles fracture. There is usually associated dorsal dislocation of the radiocarpal joint.

If you have surgery on a Barton’s fracture, it increases the full value of your pain and suffering.

Insurance Company May Say That Surgery Gets You Back To 100%

The insurance company for the responsible party may argue that open reduction internal fixation surgery on a Barton’s fracture restores articular congruity and result in good to excellent function.

The better that your function is after this fracture, the lower the value of your pain and suffering.

Will You Get a Quick Settlement if You Have a Barton’s Fracture?

Not if your Barton’s fracture is from falling.  If you fall at a business, they likely have a large insurance policy or are self-insured.

This covers falling at supermarket, store, theme park or somewhere else.  The insurance company isn’t afraid of a bad faith verdict.

A business isn’t pressured to settle since they aren’t worried about exposing their insured to a verdict above the policy limits.

You may be able to get a quicker settlement if your Barton’s fracture is from one of the following accidents:

This is because a Barton’s fracture is often worth more than the available bodily injury (“BI”) liability limits, or uninsured motorist insurance.  Be sure to make a claim against all the possible parties who may be liable.
