This is not my case. In 2006, a customer was shopping at Walmart in Palm Beach County, Florida. She slipped and fell.
She was 39 years old. She slipped and fell on water in the frozen foods aisle.
Fall Caused Lower Back and Neck Injuries
She claimed that the fall caused:
- neck pain (a cervical strain)
- a bulging disc in her lower back (L4-L5) that radiated pain to her thigh
She got money for past and future medical bills, and pain and suffering
The total verdict was for $251,213. Of that amount:
- $101,213 was for past medical bills
- $127,000 for future medical bills
- $23,000 was for pain and suffering.
The verdict was in 2008. The case is Carpineto v. Wal-Mart Stores Inc. You need to look at the court file to find out more details about this case.
My thoughts: The jury awarded $101,213 in past medical bills for two years of treatment. I assume that the shopper had surgery to her lower back.
Let’s assume that she had lower back surgery. If so, a $23,000 award for the pain and suffering component for back surgery is below the average amount awarded in past verdicts for the pain and suffering component of back surgery.
