How to Get Insurance Information in a Florida Injury Case

How to I get Insurance Information After an AccidentIf you’ve been injured in an accident in Florida caused by someone else, you may want to get a copy of all applicable liability insurance information information in writing. The good news in Florida, is that it is fairly easy to get insurance information, although it may take some time.

This article applies to all types of personal injury accidents in Florida, whether it be a car accident, slip and fall or other type of accident. If you are injured in a motor vehicle (car, truck, motorcycle, etc.) accident in Florida, it is necessary to know the insurance information for the at-fault person or company for 2 reasons:

1. The insurance company for the negligent driver or owner will be the one paying your bodily injury claim if you are injured.

2. If you purchased uninsured motorist (UM) coverage before your car accident, your UM/UIM insurance company will not pay your UM/UIM claim until the value of your injuries is greater than the at fault party’s insurance limits.

You should request the insurance policy information from the insurance company in writing. Although the insurance adjuster may tell you their insured’s bodily injury liability policy limits over the phone, it is best practice to get this information in writing to avoid any errors made by the insurance adjuster.

Also, if you have been injured in a motor vehicle accident in Florida, Florida law requires the insurance company to provide you with certain information within 30 days of receiving your request.

The easiest way to find out the name of the liability insurer is to look at the police report. Once you find out the name of the liability insurance company, the best way to find an address for an insurance company that insures policyholders in Florida is to go to the following site, Florida Office of Insurance Regulation and enter the first word or name of the insurance company.

If you can’t find the insurance company information, it is because of 1 of 3 reasons:

1. You are misspelling the insurance company name.
2. You do not have the right insurance company name. (If this is the problem,
suggest you Google the name that you have as see what names come up.)
3. The insurance company is not licensed to sell insurance in Florida. (If this is the case, this is the information that you should request and the insurance company must provide to you with:

I like to email, fax and send via certified mail a letter requesting insurance information. You can see all the information that you are entitled to get by going to Florida Statute 626.9372.

If the Florida insurance company does not respond to your request within 30 days, you can read this article on how to get an Florida insurance company to respond to your calls.  Although the title of that link refers to “calls”, the article also applies to getting the car insurance liability company to provide the information mentioned above.
