Below I discuss a recent $13,730 verdict (not my case) for a wrist fracture for a fall on a sidewalk.

I discuss the pain and suffering award in this case so that you may better know how much your wrist fracture and/or sidewalk case may be worth.

Actual Case (not mine): $13,730 for Pain and suffering only for a grossly displaced right wrist fracture resulting in permanent injury when an adult woman skater fell at an unmarked construction site.   The woman was skating on the sidewalk and fell when she hit a part of the sidewalk that was ripped apart because construction was taking place and part of the sidewalk was blocked by debris and dirt.

She sued the construction developer and Palm Beach County. The woman was found to be 75% at fault and the construction company was found to be 25% at fault. The total verdict was for $40,000 and included past medical expenses. The case is Saldia v. Palm Beach County Board of County Commissioners and Charles S. Whiteside, Inc.  The verdict was in 2013.

My thoughts:  The pain and suffering that was awarded in this case is below the amount that I suggest as the low end ($35,000) of the starting point for settlement purposes for pain and suffering on a wrist fracture. The woman was found 75% at fault so she will get 25% of the total verdict. This case shows you that trip and fall cases are difficult. In a trip and fall case, you do not have to prove that you have a permanent injury in order to get money for pain and suffering.

If the woman was hit by a car in Florida while rollerblading (as a pedestrian), she would have to prove that she had a permanent injury in order to get money for pain and suffering. I do not know what part of the wrist was broken. I could not find an appellate opinion so I do not believe that the verdict was appealed.
