Go to the Doctor or the Hospital? Effect of Injury Case Value

 You’ve been injured in an accident. Someone else was at fault. Should you go to the hospital or see a doctor?  Will going to one instead of the other affect your case value? Is one better than the other? Do you need to go to the hospital immediately after an accident to have a case?

1. All other things being equal, cases where the injured person goes to the emergency room after an accident have a higher full value than those where a person waits to see a doctor.

This is because a hospital charges a larger amount for your emergency room visit than a doctor would charge for an initial visit at his or her office.

Another reason is that a jury is more likely to believe that you were badly injured – or that your injuries were related to the accident – if you go to the emergency room immediately following an accident.

For example, just ask some friends (or strangers) about how much they think someone should get for being injured in an accident. Many will ask whether the person went to the emergency room immediately following the accident or not.

These people are the same people who sit on a jury and decide how much money you should be given for your injuries.

But if you see a doctor immediately after an accident, it is still good for your case.  If you are injured in a car accident in Florida, you should be sure to give your car insurance and health insurance information to the hospital and doctors.

The above comparison is between going to the hospital first or seeing a doctor.  However, for cruise accident cases, an infirmary on a cruise ship is treated the same as going to the emergency room.

2. The decision whether to go to the ER or see a doctor depends on your gut feeling.

There isn’t a right or wrong answer, however going to the ER can be a life saver if you have life threatening injuries that you may be unaware of. An example of this was the skiing accident where Liam Neeson’s wife fell and injured her head. She thought it was “just” a headache. Her brain quickly swelled and she died shortly thereafter.

The bottom line is that the sooner that you get medical treatment for your injuries after your accident, the better it is for your personal injury case.

Many cases have been settled for a lot of money even though the injured person never received ER treatment. The bottom line is if you feel like you treatment that you should get it.  It’s better to be safe than sorry.
