1. Florida Personal Injury Experience

It is a good sign if the attorney has been representing personal injury victims for a long time, preferably 7 years or more. This is not to say that an attorney with under 7 years experience is not able to give you excellent representation. However, 11 years is a good number to use as a benchmark.

If an attorney is just out of law school, you should ask him or her whether he or she had experience working for a personal injury law firm (or law firm representing the insurance company) or was an insurance adjuster before becoming a Florida lawyer.

If the attorney has had a lot of experience working for law firms or a liability insurance company before becoming an attorney, this is a good sign.

2. Number of Personal Injury Cases Settled. 

The greater the number of cases settled, the better. However, an Florida attorney who has only handled a few Florida personal injury cases can still do a good job depending on the type of case and whether they handle it with a more experienced attorney.

However, if Attorney A has settled more cases than Attorney B, I recommend hiring Attorney A.

3. Is attorney paid from the total recovery, or after my medical bills, lien’s and costs are paid?

Although a personal injury lawyer should tell you this so that you understand how much they will be paid at the end of your claim, you definitely should ask this ahead of time.

This will avoid you being surprised and disappointed at the end of the claim when you realize that the attorney was paid from the total settlement if you thought he/she would be paid after your bills and costs were paid. It is standard practice in Florida for a personal injury lawyer to be paid from the total settlement.

4. Responsiveness to telephone calls or emails.

Hopefully the attorney responds to your telephone calls and emails the same day that you send them. It is understandable that if the attorney is in trial that he/she returns your call the next day.
