This is a letter that I may use if I represent a client who is injured in an accident and I want to get his or her hospital bills reduced.

Dear Mr. Christopher Clark,

Please allow this letter to serve as a follow up to our telephone conversation on March 10, 2008 at which time we discussed liens that Memorial Regional Health Systems may file against its patients. Thank you again for your time on the phone. My client/your patient is Personal Injury Victim.

The treatment rendered to Accident Victim by the various facilities of the South Broward Hospital District was necessitated by injuries she sustained in a bicycle /motor vehicle accident that occurred on February 25, 2008. Her injuries were severe. To my understanding, she has been left with rods and/or pins throughout her face as well as significant scarring and disfigurement which includes but is not limited to obvious disfigurements to her face and trunk. She also has a metal plate inserted in her face. She continues to undergo treatment for her various injuries and will require additional treatment well into the future. In addition, it is undetermined if and when she will be able to obtain any future gainful employment.

More specifically, my understanding of Car Accident Victim’s injuries include, but are not limited to:

1. Multiple Fractures of her face, wherein at least five (5) screws are permanently inserted.

2. Two (2) collapsed lungs.

3. Eye problems.

As a result of her injuries she has already undergone:

1. Multiple Surgeries on her face.

2. Procedures to her lungs which apparently collapsed.

Unfortunately, the at-fault driver who caused the accident in which Bicycle Accident Victim’s was injured is only insured for $100,000. It was just as unfortunate that  Auto Accident Victim did not have her own automobile insurance policy therefore she had no uninsured motorist benefits against which she could have attempted to make a claim for her damages. I believe that I will be able to able to secure the bodily injury limits of $100,000.00

However, upon further investigation, this Law Firm did learn that Truck Accident Victim’s son-in-law has an automobile policy with GEICO which may provide up to $10,000 in PIP Benefits. As such, we are making a claim against GEICO for the Bike Accident Victim’s son-in-laws no fault benefits, although she may not have been listed on the policy.

Unfortunately, the amount recovered is woefully insufficient to cover all of Truck Crash Victim’s outstanding bills, including attorneys fees, costs and medical liens. Should the settlement be exhausted on those costs only, Personal Injury Victim, who does not have health insurance, will be unable to support herself in the future and she will further and more importantly be unable to pay for necessary future medical care. It is our hope to resolve all of Car Crash Victim’s outstanding expenses and be able to still provide her with some money for future living expenses and medical care.

As such we are proposing a 1/3 proportional division of the settlement proceeds after attorneys fees and costs as follow:

Settlement – $100,000.00

Attorneys Fees and Costs – $33,333.93

Remainder – $66,666.07

Divided by 2 – $33,333.04 for Auto Crash Victim; $33,333.03 to be distributed to providers for outstanding liens.

Assuming we can get the other providers (which include or may include, but are not limited to, Broward Sheriff Office (BSO) Air Rescue, Emergency department physicians, radiologists, pathologists, anesthesiologists and consulting physicians) who have liens on this claim to cooperate, we would like to resolve the South Broward Hospital District’s Lien from the $33,333.03 set aside for all provider’s outstanding liens. Unfortunately, I do not expect the BSO Air Rescue, Emergency department physicians, radiologists, pathologists, anesthesiologists and consulting physicians to reduce their bills at all.

I have attached a copy of the proposed closing statement identifying all outstanding liens that I am aware of as of this time along with bills supporting those liens. (PLEASE NOTE THAT WE BELIEVE THE OUTSTANDING BILLS FOR MEMORIAL HEALTHCARE SYSTEM AS IDENTIFIED ON THE CLOSING STATEMENT MAY BE GREATER THAN INDICATED BUT WHAT IS IDENTIFIED IS ALL THAT WE HAVE RECEIVED VIA REVIEW OF MEDICAL BILLS TO DATE). The attached closing statement is not the proposed closing statement, rather it shows the debt that Ms. Accident Victim may incur at this time.
