The Driver was found guilty (after being prosecuted by the State Attorney) of DUI (Driving Under the Influence) by a criminal court. My client went to the hospital in Miami shortly after the accident. The Emergency Room doctor diagnosed her with a neck sprain.
He also diagnosed her as having a lumbar sprain along with a contusion of lower limb. The ER record stated that the location of her pain/injuries was her head, chest, back (upper mid and lower) and her left leg. Her severity of pain was listed as mild to moderate. She was wearing her seatbelt and the air bags in her car deployed.
She received therapy from a chiropractor for months after the accident. She also saw a psychologist as she was extremely nervous following the accident. We represented our client against the DUI driver’s insurance company. We filed a claim against the passenger’s underinsured motorist company (State Farm).
