Crime Victims Rights in Court and Clemency Matters

Crime victims are entitled to notice informing them of court proceedings and the right to attend court hearings.  Injury victims can speak with the state attorney to express their feelings.   If the crime victim’s property was damaged during the time when they were injured by a criminal, they are entitled to the quick return of property held for the court case. The exception to this is if their is a very important police reason to keep it.  The state attorney can let a crime victim’s employer know that they need to cooperate in the criminal case.  Sometimes the state may explain to creditors the reason that the victim cannot pay their bills.  Crime victims have the right to request restitution. For serious personal injury matter, Justin will work with the state attorney to attempt to get you restitution.  You also have the right to give a statement as to how the crime has affected your life.  If the defendant escapes jail or prison, you have the right to know.  You are also given general assistance.

Relatives who are related to any dead accident victim are given information explaining the death clemency process. notification that a Florida Parole Commission Investigator will be requesting an interview and the nature of the interview, victims will be offered the opportunity to submit written impact information in lieu of an interview; notification and explanation of a clemency hearing; opportunity to be present and submit a written statement or an oral statement at the clemency hearing; upon request, victims may receive copies of the actual transcript of any statements or testimony of the inmate
