Trip and Fall Lawyer Makes Claim (and potential lawsuit) against CVS for client's fractured foot.

Our client a middle aged woman, tripped on a container which was misplaced in the aisle without any warning signs near it. The hospital report stated that she fractured her heel bone (calcaneus) and had various injuries to her knee, ankle, leg, and back. She was given a unna boot.* The second podiatrist, other than the emergency room physician, that examined our client stated that she had tenosynovitis.**

As mentioned in the trip and fall settlements page, because CVS has basically denied liability by not offering our client a single dollar, we are preparing to file a personal injury lawsuit against the store.

*An unna's boot is a unique fabric (generally four inches in width and ten yards in length) that is used to relieve venous stasis ulcers and different venous inadequacies of a person's leg. An unna boot is also be a supporting bandage for injuries, such as strains and sprains of the foot, lower appendage, and ankle. The gauze is usually coated with a dense, creamy combination of calamine and zinc oxide which help healing. The gauze also may be filled with glycerin, white petrolatum, acacia, or castor oil. Unna's boot was given its name for the German dermatologist Paul Gerson Unna.

**Tenosynovitis is the pain and swelling of the synovium (which is also known as fluid-completed sheath which contains the tendon. Common symptoms of tenosynovitis are swelling, pain, and having a hard time moving a certain joint at the site of the inflammation. Sometimes tenosynovitis can cause the finger to stay in a forced position, which is known as stenosing tenosynovitis, and also referred to as trigger finger. Many times it happens with tendinitis and is a relative of stenosing tenosynovitis. Some of the symptoms of tenosynovitis are difficulty moving joints, swelling, pain and sensitivity on the outside of the joint, specifically in the foot, ankle, wrist and hand.  If a person moves the joint, they likewise have pain.
