I suffered personal injury in a car accident. Can I make a claim and/or lawsuit against the driver and/or owner of the car responsible for the accident?

Yes. Although unfortunately not required in Florida, we will investigate to determine whether the driver and/or owner of the at fault car has bodily injury insurance. If you've suffered personal injury, the first insurance company that we will make a claim against is the at fault driver's bodily injury liability insurance. (Bodily injury liability insurance is often referred to as B.I.) Bodily injury liability provides protection if they've injured or killed you (or a relative or spouse) while carelessly operating their car. It also provides for their legal defense if you (the person whose suffered personal injury) in the accident files a lawsuit against them.

In the event of a serious accident, we will do everything possible to investigate to make sure that the at fault driver has enough insurance to cover your injuries. The at fault driver's Bodily injury liability covers injury to people, not your vehicle. If the at fault driver and/or owner does not have enough bodily injury insurance to cover your personal injury (medical bills, pain and suffering, etc.) we will determine whether you have uninsured motorist insurance and make a claim against that coverage. If your injuries are worth more than the at fault car driver's bodily injury insurance, and you do not have uninsured/underinsured motorist coverage, we will determine whether they can pay a judgment against them in a lawsuit. In Florida, it is very difficult to go after their personal assets.
